- Refund Eligibility: Refunds will be considered in accordance with the Consumer Protection Act, 2012, which provides for refunds in cases where goods or services are not delivered as promised. Section 54 of the Act allows for the right to request a refund if goods or services are not as described or if they fail to meet the consumer’s reasonable expectations.
- Work Commencement: Once work has started, or services have been partially or fully provided, a refund is not applicable, as outlined in the Consumer Protection Act, 2012, which recognizes that service agreements are based on performance and obligations of both parties. Section 56 of the Act provides for circumstances where the consumer cannot seek a refund once performance has commenced.
- Custom Tailored Services: Many of the services we provide, such as legal consultations and document preparation, are personalized to meet your unique needs. Section 56(2) of the Consumer Protection Act also acknowledges that custom services, where the consumer has agreed to specific terms, are non refundable once completed.
- Exceptional Circumstances: In the event that we fail to provide services in accordance with the agreement or there is a breach on our part, we will review the matter and offer an appropriate solution. Refunds may be considered under these circumstances, as stipulated by Section 57 of the Consumer Protection Act, which ensures that consumers are entitled to remedies if the service provided is inadequate or not as agreed.
- Soft Law Considerations: We also adhere to the general principles of good faith and fair dealings in service contracts, which are emphasized under soft law frameworks such as the United Nations Guidelines for Consumer Protection and principles outlined by the International Chamber of Commerce (ICC). These soft law instruments encourage businesses to act fairly and transparently, which we are committed to doing.
